Is it a Good Idea to File a Trademark Application on My Own?

Thousands of people file their own trademark applications each year.  Most of these prospective trademark owners are in the beginning stages of launching a new venture and are understandably concerned about staying within their budgets and making sure they have money for all of the other important things they need.  But if you’re like most people, you might not have enough information to make an informed decision as to whether filing your own trademark application is in your best interest.  So, here are three potential issues to think about:

Issue #1 – What If I Make a Mistake?

The USPTO trademark application form is not as straightforward and simple as it might initially seem.  It’s very easy to make inadvertent errors and not even know about them until you receive a trademark office action from a trademark examining attorney.  Although some mistakes are able to be corrected after your application is filed, many are not.  If your trademark application contains an error that cannot be fixed, you’ll have wasted the filing fee that you paid to the USPTO.  Your only choice will be to file a brand new application and pay another government filing fee.  More importantly, you will lose your federal priority filing date, which can be disastrous if someone else happens to file an application for a confusingly similar trademark before you can submit a new application.

Issue #2 – Rejections and Delays

A trademark application filed by an experienced trademark lawyer is much more likely to (1) be approved by the United States Patent and Trademark Office, and (2) not challenged by other parties.  This is because your application will be complete and accurate.  Trademark attorneys know exactly which questions to ask you to obtain all the information they need to ensure that your trademark application is properly prepared and timely filed.  Avoiding unnecessary rejections and delays (not to mention trademark oppositions) during the trademark application process is the key to keeping trademark registration costs as low as possible.

Using an Online Trademark Service vs. Hiring a Trademark Attorney

OK, you’ve decided that you don’t want to go through the US trademark application process by yourself because you want to minimize the risk of your trademark application being rejected after it’s reviewed by a trademark examining attorney at the USPTO.  So, what options do you have for seeking trademark protection for your valuable name, logo, or slogan?

Option #1 – Use a Trademark Filing Company

A quick Internet search uncovers plenty of trademark filing companies claiming to be “the best trademark company” or “the best trademark filing service” or “the best trademark registration service.”  As a trademark registration lawyer, I find these claims laughable because none of these trademark filing services provide any real service at all.  These are do-it-yourself trademark filing companies.  What they offer isn’t much different than what’s offered by the United States Patent and Trademark Office on its own website.  In other words, filing a trademark application through one of these companies is essentially the same as filing a trademark application yourself through the official TEAS system.  In addition, these companies will be nowhere to be found after your application is filed.  The minute after they click “submit” on your application, you’ll be pretty much on your own.  It will be you against the USPTO trademark attorney in charge of examining your application.  That’s not somewhere you want to be if you’ve already determined that navigating the trademark registration process alone isn’t for you.

Option #2 – Hire a Cheap Trademark Lawyer

Another quick Internet search reveals dozens of cheap trademark attorneys competing for your business.  For example, they might offer to perform a comprehensive trademark search for a very low price.  But that comprehensive search often comes with no legal advice or professional opinion as to whether you’ll successfully achieve a registered trademark.  Or, these cheap trademark registration attorneys might offer to file a trademark application for a fee that seems almost too good to be true.  Well, that’s because you won’t receive a thorough explanation of the trademark process and it will probably be difficult to reach them personally once they have your money and file your application.  Plus, what will be the chances of them being available if something unexpected happens during the trademark registration process (such as a trademark opposition)?  Will they be responsive if you have important questions or concerns about trademark protection that need to be addressed?  Will you be able to go to them if your registered trademark is later challenged?  How much experience do they even have filing trademark applications with the Trademark Office?  We all know that in life we generally get what we pay for.  Trademark lawyer services are no exception.
