I am searching for horror stories about people (including many attorneys) who rely on the PTO's TESS search system before adopting a mark or advising a client and came across your article. Many years ago we did a pretty exhaustive study of TESS data to show the PTO how bad the system was and they pretty much said they didn't care. Besides mispelled marks try playing with mispelled words in the goods or services field. I took the word educational from your example and spelled it edcutational, eduational, eductional, educatoinal, educatinal, educatonal and found 100 marks, many of them active registrations. There are thousands of data errors in TESS. I know we are competitors in that we both do trademark searches but I like to point these things out to anybody interested in the topic.
